Ex- Federal Bureau of Investigation director James the former director has entered an innocent plea to giving untrue testimony to lawmakers and hindering a congressional proceeding.
The former director's legal representative filed the plea acting as his counsel in a federal court in the Virginia city of Alexandria on Wednesday morning.
The defense lawyer declared he would attempt to have the proceedings terminated for various reasons including that his the accused, a detractor of Donald Trump, was being selectively prosecuted.
Mr Comey was indicted just days after Donald Trump urged his chief prosecutor to proceed against him.
Legal Proceedings
In court on mid-week, the defense counsel the legal representative advised the magistrate they planned to submit various legal requests to dismiss the legal matter before a trial, claiming the government's case was vindictive and that a federal prosecutor was unlawfully assigned to handle the legal matter.
Mr Comey's case was originally managed by a Virginia prosecutor, who left his position under pressure from Donald Trump after his investigation into another rival - NY AG Letitia James - failed to initiate prosecution.
Judicial Environment
Mr Comey appeared in good spirits as he entered the court on mid-week, speaking with his lawyers and making jokes. He was joined by his spouse, Patrice Failor and offspring Maureen Comey, a US lawyer who the previous administration terminated.
After listening to the magistrate read his legal protections and the two counts against him in court on mid-week, James Comey was asked if he comprehended the charges.
"Yes your honour. Appreciate it," he informed the proceedings.
Background Context
James Comey was the head of the FBI from four years and was dismissed about several months into the former president's first administration as commander-in-chief. At the moment, the director was leading an examination into foreign election meddling and whether there were any links between the Russian government and Trump's campaign.
During his tenure, the director triggered a negative reaction from Democrats when he stated just immediately preceding the 2016 presidential election that he was examining Democratic candidate Clinton's use of a private email server. Indictments against Hillary Clinton were never brought, leading to disapproval from conservative politicians as well.
Ongoing Accusations
The federal government claim Mr Comey provided false information to Congress during a legislative proceeding in September 2020 when he was being questioned about both the email probe as well as the foreign influence inquiry. They say he misled the legislative body by saying he had not permitted someone at the agency to disclose to media organizations information about the government examinations.
Prosecutors also accuse the defendant of "improperly attempting to influence, hinder and delay" the legislative group by making false statements to it.
Personal Comments
Through a recording Mr Comey published to his Instagram after he was indicted, he declared he was wrongly accused and alleged Trump of behaving like a "autocrat".
"We have known for years that there are consequences to opposing Donald Trump," he stated. "We refuse to live on our knees."
"I have done nothing wrong," he continued. "So let's have a trial."
The charges against James Comey emerged after Donald Trump posted on online platforms demanding his attorney general, Pam Bondi, prosecute James Comey and additional individuals.
